What is a declaration of compliance?

A declaration of compliance is a submission to The Pension regulator to confirm the action you have taken on your Staging Date. A “Declaration of Compliance” MUST be made to the Pensions Regulator once all
employees have been assessed and, if necessary, auto-enrolled. This must be done within a five month period following the Staging date and again five months after each re-enrolment date. This declaration must be made by ALL employers, even if you do not have any employees who need to be auto-enrolled and have not set up a pension scheme. This declaration must be made in a tightly specified format and must contain information on a number of aspects of the client’s pension scheme and the way it has been implemented. A penalty of £400 will be applied to any employer failing to complete this in time or failing to provide the required information.
